Blatant Insider Commodity Trading Given Pass That

Quite incredible — as reported in The New York Times last week which quotes Reuters — that Chesapeake Energy’s chief executive Aubrey K. McClendon, while acting as Chesapeake’s Chairman and CEO had run a “hedge fund that traded commodities, including natural gas futures Windows 7 Activation Key, for at least four years while he led Chesapeake’s vast expansion of gas drilling” and oversaw his companies’ hedging activities in oil and gas futures. The $200 million fund, Heritage Management Company Server 2003 Key, used Chesapeake’s Oklahoma City headquarters as its mailing address.

Certainly nice work if you can get it. And that’s the rub, according to our heavily lobbied Commodity Exchanges and Wall Street-influenced law — commodity trading is more loosely regulated than equity markets. Referring to McClendon’s catbird seat at the gaming table Morningstar analyst Mark Hanson was quoted in the article picked up from Reuters, “If he knows Chesapeake is to ramp up or curtail production, he could enter into positions in his hedge funds that could benefit from that.” Had it been the stocks and bonds of his company trading on insider information, the SEC would have made an appearance bearing handcuffs.

Here we have this enormous dichotomy between insider trading in stocks and bonds, and commodities. The difference being, with commodity trading most everyone is impacted. Insider trading in oil and gas, as Chevron showed us wherein Chevron traders held oil and product contracts for 27 million barrels of oil and trading profits (remember, not producing and selling, but trading alone) for the first seven months of 2011 alone of over $260 million — profits that came from trades, that one can well assume were not meant to push prices of their core products down, and thus those trading profits were underwritten by the rest of us in higher gasoline, heating oil, diesel prices.

As I said, it’s good work if you can get it. And it is long overdue that commodities trading oversight and regulation be put on the same playing field as trading in stocks and bonds Server 2008 Key, with the same level of enforcement — both civil and criminal — as those that apply to insider trading under our securities laws.

Banking Wars

The banking wars are getting more and more interesting. The legal and political implications are bigger than most people understand, and the players involved need to be very careful with the loaded guns they are gesturing with or they might shoot themselves in the foot (or perhaps an even more vulnerable body part.)

Underlying the entire drama is this fundamental subtext: the American people are fundamentally (and correctly) cynical about how the big bankers always seem to get away with whatever they want to get away with. Bailing out the bankers with no strings attached in order to save an economy that didn’t seem to most people to be very well saved, then watching the banks get record profits and bonuses the very next year while the rest of the economy was in the toilet didn’t engender much good cheer about whether justice had been done. Neither have the tons of books, news articles, and blog posts about the things these bankers were able to get away with in the course of the buildup to the crisis and the things that have happened since.

The new financial fraud task force the president announced in his State of the Union address replica watches, co-chaired by avowed Wall Street antagonist Eric Schneiderman from New York, was supposed to help staunch the cynicism about whether the masters of the Wall Street universe would ever be held accountable. Many of us who have been working on banking and housing issues had been calling for a deeper investigation of the banks, and when we got it, we were delighted, especially with Schneiderman playing such a leading role. But the success of this task force still hangs in the balance. A lot of questions have been raised by various groups and individuals working on this, including me, about how fast the task force was moving and whether the White House was focused on making sure things were effectively moving. Meanwhile, Republicans like Rep. Patrick McHenry replica watches, eager to serve their corporate masters on Wall Street, have started harassing and trying to slow down the task force in its work by forcing them to respond to threatening letters that are pure fishing expeditions.

The good news is that after what felt to a lot of activists like a very slow start, things seem like they are starting to come together in the task force. From everything I hear, the DOJ staffers that were to be assigned to the task force are now working, an executive director is likely to be on the verge of being hired, and other agencies including CFPB and HUD are actively and productively engaged and contributing resources. My sense is that there was some initial foot dragging by DOJ, but things are starting to move. And I think the flurry of questions and email petitions over the last couple of weeks did have the desired effect in getting the White House more involved in encouraging the bureaucracy to keep moving.

It will be very hard to know, of course, what is really going in a legal investigation that has to be confidential in releasing information they are finding in the investigation. It will be a long spring and summer for those of us who care about accountability for the banks, because the wheels of justice take some time to move, and I would guess that the earliest indictments could start flying is several months from now. In the meantime, activists will need to keep the heat on.

Turning from the legal back to the problem of the public’s cynicism about whether the big bankers will ever be held to account, the Obama administration does itself no favors when Treasury Secretary Geithner makes it sound like the administration has already decided not to prosecute anything. From Reuters:

“Most financial crises are caused by a mix of stupidity and greed and recklessness and risk-taking and hope,” said Geithner, who helped tackle the crisis for the Bush administration when he was the head of the New York Federal Reserve and has been urging Europe to act more aggressively to contain its debt problems. “You can’t legislate away stupidity and risk-taking and greed and recklessness. What you can do is make sure when it happens it does not cause too much damage and to do that you have to make sure you have good rules against fraud and abuse, better protections and you force banks to hold more capital against their risk,” he said.

This statement unfortunately echoed Attorney General Eric Holder’s statement after the task force was announced that in his assessment the problems were not mostly related to law-breaking but to greed and stupidity. Whoever is writing the talking points for these guys needs to be fired. The politics and optics of the president announcing a task force to look into Wall Street fraud, and then having his AG and Treasury Secretary announce that there probably weren’t many laws broken in advance of the investigation, is atrocious. If the president loses populist swing voters mad at Wall Street, and therefore the election, I’d recommend looking for a cause first at Geithner for statements like this and policies that have treated Wall Street with kid gloves.

Speaking of those swing voters: one of the biggest unresolved issues in the 2012 election will be whether President Obama can convince the swing voters who are both angry at Wall Street and skeptical of government — in great part because they think it is bought off by wealthy special interests like Wall Street bankers — that he will actually hold Wall Street accountable. Thirty-seven percent of voters in the 2010 exit polls, when asked who was primarily to blame for the economic problems the country was facing, said Wall Street — far more than any other person or institution named. That populist group of voters who blamed Wall Street first ended up breaking 56-42 for Republican candidates (after voting for Obama 2-1 in 2008) because they perceived that Obama was, in the haunting phrase of EJ Dionne, a “Wall Street liberal” — someone who was both too close to Wall Street and pro-big government. These mostly working class voters, many of them hard pressed economically, many of them with underwater mortgages, are under no illusions that Romney is a Wall Street guy through and through, which is why he had so much trouble with working class voters in the Republican primaries. But they don’t trust government or Obama either, and might well vote against the incumbent if they don’t see him taking on Wall Street. If these voters think both presidential candidates will coddle Wall Street, their tendency will be to vote for the one they think will keep taxes down and lower the deficit.

The fraud task force is burdened by three and a half years of virtually no visible action against the Wall Street fraud that helped bring down this economy, and by big expectations coming from the activists on this issue. Cynicism is high, and patience is low. I sympathize with those inside the task force to whom this feels unfair, but the bottom line is that they have to deliver something tangible replica watches, and relatively soon, to show that the big boys on Wall Street have to obey the same laws that everyone else does- that when they cheat their clients and cheat on their taxes and fraudulently manipulate markets, that they will be investigated, prosecuted, and spend some time in jail. If the task force can begin to deliver that kind of accountability, people are going to be a lot less cynical about their government.

New York, NY – Council Speaker Christine Quinn stormed out of what should have been a celebratory City Hall rally for a “living wage” bill Monday after one participant insulted Mayor Bloomberg.

Quinn had just begun thanking supporters — Bronx borough President Ruben Diaz, Public Advocate Bill de Blasio and Mayor Bloomberg — when retiree Carlos Pacheco, 62, shouted out: “Pharoah Bloomberg.”

Former AFL player loses jail term appeal

Former AFL footballer Fabian Francis has lost an appeal against his jail sentence for domestic violence.

Francis, 38, was found guilty by a jury last year of eight charges relating to threats and assaults on his ex-wife, a former police officer Debra Buckskin.

Justice Kourakis said the consequences of an offender's imprisonment on his or her family should be considered on case-by-case in sentencing.

“The effects of the imprisonment of an offender on his or her children or other dependents must be considered in the circumstances of each case and an appropriate balance struck between their welfare and the need to protect the community,” he said.

“In sentencing offenders for repeated acts of domestic violence committed over protracted periods of time, deterrence is a paramount consideration.

“The predicament of [Francis's new partner] and her children is a difficult and a sad one, however it is not of an order which would justify a reversal of the sentencing judge's decision not to suspend.”

Greek conservative leader says unable to form gove

ATHENS (Reuters) – Greek conservative leader Antonis Samaras said on Monday he had failed to form a coalition government and had handed back the mandate to the country’s president.

Chevrolet Camaro sales still outpacing rival Ford

The 2011 Chevrolet Camaro is still outselling the Ford Mustang Tattoo Supplies, netting 19,972 sales through March compared to the Mustang’s 15,419. Both cars handily outsold the Dodge Challenger, which itself is selling fairly well with 9,742 units through the same period. This is the second year running (well, so far this year at least) that the Camaro has managed stronger sales figures than the Mustang, having overtaken it last year for the first time since 1985.

GM figures the Camaro’s success could be attributable to its relative newness in the pony car stable, having debuted in 2009. The Mustang has only undergone slight changes to its outward appearance since its 2004 redesign, though it’s been kept well freshened in the engine bay. To help boost Camaro sales, Chevrolet says the V6 will get an 11-horsepower bump by this summer, taking the base Camaro to a total of 323 horsepower.

With such a big sales head start, it seems unlikely the Camaro will be caught before the end of the year Tattoo Supplies, despite Ford’s revised powertrain options for 2011 and the limited-production Mustang Boss 302 hitting dealerships soon.

Man charged over NSW policeman’s murder

2009 was a tough year for nearly every automaker doing business in the U.S. Cheap DKNY Clothing, but somehow Hyundai made the near total collapse of auto sales look like no big deal. Hyundai is likely pretty happy with its 2009 performance, yet the Korean automaker wants more in 2010. Spectators at a Phillies-Mets baseball game broke into chants of “U-S-A, U-S-A” as news of Osama Bin Laden’s death made its way through the crowd on Sunday night. When did Americans start yelling the name of their country over and over again to express joy or patriotic pride?

Probably in the mid-1970s. There’s a legend going around that the now ubiquitous U-S-A chant got started at the 1980 “Miracle on Ice” hockey game, when the United States Olympic men’s team Fake Tissot Watches, made up of amateurs, defeated the mighty Soviets. While certainly charming and tailor-made for a Hollywood screenplay, the story isn’t true. The actual origins of the chant remain shrouded in mystery, but news stories as early as 1975 describe sports crowds repeating “U-S-A.” For example, at that year’s National Association of Intercollegiate Athletics swimming championships, the crowd started the chant to protest the inclusion of a Canadian team that went on to win the predominantly American event. In the 1976 Olympic ice hockey tournament, four years before the Miracle on Ice, the crowd broke out the abbreviation when the Americans defeated the Finnish team.

None of the reports from the 1970s indicate that the chant was revolutionary, or even novel, but it’s possible the journalists working at the time didn’t realize they were witnessing the birth of a phenomenon. Whether it was truly new or not, there is evidence that it was not yet our defining national cheer. News reports from the same era often describe slightly different patriotic cheers. U.S. Coast Guard personnel waiting to sail their vessel at a multinational ship exhibition in 1976 chanted “U-S-A, U-S-A., we don’t mess around, hey!” In 1970, blue-collar supporters of President Nixon—including those working to build the new World Trade Center towers—held a rally in Lower Manhattan. When a peace activist appeared to spit on an American flag, the construction workers broke out into cries of “U-S-A, all the way.” It’s hard to imagine any chant other than “U-S-A, U-S-A” spreading after such an incident today. [Update, May 3: As a commenter points out, close variants of the "U-S-A" chant appeared earlier than the '70s. German filmmaker Leni Riefenstahl's documentary of the 1936 Berlin Olympics contains audio of American fans shouting, "U-S-A, U-S-A, oi, oi, oi How to buy Replica Oris Watches," which closely resembles the modern Australian cheer, "Aussie, Aussie, Aussie Where find Replica Panerai Watches, oi, oi, oi."]

While the chant certainly was not born in 1980, it does appear to have taken off after the Miracle on Ice. A Google News archive search for “chant ‘USA USA’ ” turns up only nine hits before 1980. The same search for the next decade results in 713 hits.

Celebrating outside the White House

Patriotic cheers are not, of course, a uniquely American phenomenon. England’s soccer fans, for example, are expected to be able to participate in a wide variety of chants and songs. Some of the cheers involve only the word “England,” but they typically have a more complex rhythm than the U-S-A chant. French supporters holler “Allez les Bleus!” in support of their blue-clad soccer team. Canada sticks more to the American model, with chants of CA-NA-DA raining from the rafters at hockey games. They also chant “Go, Canada, Go.” In 2009, Pepsi tried to get Canucks to chant the slightly more complicated cheer “Eh! O’ Canada Go!” as part of a marketing campaign Imitation Movado Watches, but it doesn’t appear to have caught on.

Bonus Explainer: Crowds in Boston broke out cigars to celebrate the killing of Bin Laden. When did cigars become associated with celebrations? Possibly before the pilgrims landed. Much like the U-S-A chant, the origins of the celebratory cigar aren’t well-documented. Indigenous peoples in the West, and especially the Pacific Northwest, engaged in a practice called “potlatch”—a festival usually held on a special occasion in which a family distributes valuable gifts to the community. Tobacco was one of the gifts passed out in these celebrations, leading some to believe that the tradition of distributing cigars on auspicious occasions is Native American in origin. If early European settlers did, in fact, pick up the practice from Native Americans, the tobacco would have been smoked in a pipe. Cigars didn’t make landfall in the U.S. until 1762.
